TEQUILA AUSTRALIA PTY LIMITED “GALLIANO HOTTEST BARTENDER” COMPETITION TERMS AND CONDITIONS 1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions. 2. Entry is only open to Australian residents aged over 18 years who are employed (either on a full time, part time or casual basis) as bartenders as at the date of their entry into this competition, and who can produce a current Responsible service of alcohol certificate from their state authority. Employees (and their immediate families) of the Promoter and agencies associated with this competition are ineligible to enter. 3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4. Incomplete or indecipherable entries will be deemed invalid. Only one entry permitted per person. 5. Promotion commences 1st September, 2008. Entries close 11:59pm AEST on 29th September, 2008. Finalists will be notified by phone and email on 6th October, 2008. This is a game of skill and chance plays no part in the determination of finalists or the winner. Each entry will be individually judged according to the specified criteria. Entry 6. To enter, entrants must visit cosmopolitan.com.au/hottestbartender.htm, follow the prompts to the competition entry page, input all the requested details and information, including a photograph of themselves (photograph must be no more than 3 months old), your original recipe for a drink containing Galliano, the methodology and reasoning behind the original drink’s creation and why the entrant has the “Galliano X factor”. 7. The original drink recipe: (a) must contain a minimum of 15ml Galliano; (b) may contain a maximum of 60ml alcohol (in total); (c) may use up to 4 (including all dashes and drops) additional ingredients (recognised brands only) using Maxxium brands where applicable; (d) must not include any “home mix” or “home brew” ingredients; (e) may include a garnish (which will not be counted as an ingredient) which does not contribute to the taste of the drink; and (f) specify the style and size of glass to be used. Selection of finalists 8. Finalists will be selected on the basis of the bartender’s presentation (as per their submitted photograph) and their drink’s originality, name, method and overall balance (“Finalist Criteria”). The 10 best valid entries, as selected by the judges in their sole discretion, according to the Finalist Criteria (“Finalists”), will receive the opportunity to compete at the Sydney competition on 22nd October 2008 (or other date as may be advised by the Promoter). The opportunity to compete at the Sydney competition will include a subscription to B&C valued at $55, a return economy class airfare from the winner’s capital city to Sydney for the Finalist and one night’s accommodation at Vibe Hotel. If a Finalist is from NSW, then the prize does not include airfares and the airfare component is not redeemable for cash. Spending money, additional meals, insurance, transport to and from departure point and all other ancillary costs are not included. Prize must be taken to coincide with the Sydney competition and is subject to booking and flight availability. The 10 best valid entries selected will also receive a ticket to the Galliano Hottest Bartender Reveal Party on 4th March, 2009. Sydney competition 9. In order to be eligible to win the prize, the selected Finalists must participate in the Sydney competition. The order of performance on the day will be entirely at the Promoter’s discretion. The Promoter will provide the Galliano, glassware and bar tools. Unless otherwise advised, Finalists will be required to provide all other items including their own additional ingredients. Finalists must: (a) make 3 x their original drink (as specified on their entry); and (b) correctly answer any questions posed by the judges regarding either their original drink and/or Galliano. Finalists will be given 5 minutes to prepare their bar area and garnishes and then 10 minutes to create the 3 x original drink. Points will be deducted for running overtime at the rate of 1 point per minute. 10. The Promoter reserves the right to disqualify any Finalist who the Promoter deems, in their sole discretion, to have not been the original creator of the drink, to have not prepared the original drink as specified in their entry or to not be competing in a sportsmanlike manner. 11. All Finalists who successfully compete (ie who are not disqualified) in the Sydney competition will be invited to participate in the photo shoot for Cosmopolitan magazine which will take place on the day of the Sydney competition. Finalists will be advised in advance of any further requirements with respect to the photo shoot. 12. If a Finalist does not confirm their intention to participate in the Sydney competition by 5pm AEST on 13th October, 2008 they will forfeit the opportunity to participate and the next best entry will be selected in their place. If that next selected entrant does not claim the prize within 24 hours of phone notification, then they will forfeit the prize and this process will continue until a finalist is determined. 13. If for any reason a Finalist does not attend the Sydney competition or participate in the Sydney competition, for any reason whatsoever, at the time stipulated by the Promoter, then they will forfeit the opportunity and it will not be redeemable for cash. Determination of winner 14. The winner will be determined both by the judges (50%) and by a reader vote online at www.cosmopolitan.com.au/hottestbartender.htm (50%). 15. The judges’ component of the determination of the winner will be based upon both the Finalist Criteria and the bartender’s performance at the Sydney competition. The bartender’s performance at the Sydney competition will be scored against the following criteria: Method (30points) – method and reasoning in creating original drink; Original Drink (30points) – including taste and presentation; and Galliano X factor (40points). Online Voting 16. Voting commences Monday 1st December, 2008 and closes 11:59pm, AEST on 30th January 2009 for the Hottest Bartender of 2009. Entrants into the ‘Reveal Party Win tickets’ promotion do not have to vote for a bartender to enter the competition. 17. Votes can be made on any of the Top 10 bartenders featured on the Cosmopolitan website cosmopolitan.com.au/hottestbartender.htm during the Voting Period. Each voter can only vote once per calendar day. Once a vote is made, the voter will automatically be denied access to vote again on the same day. 18. The best Finalist, as selected by both the judges and the Cosmopolitan readers’ vote, will be determined to be the winner and will win $2,000. If there is a tie, then the judges will determine the winner in their sole discretion. The Promoter’s decision in respect of all aspects of the competition is final and no correspondence will be entered into. The winner will be announced at the Reveal Party on the 4th of March 2009. 19. Prize will be awarded in the form of a cheque. Prize is not transferable or exchangeable and cannot be taken as cash. 20. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) to modify, suspend, terminate or cancel the competition, as appropriate. 21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. 22. All entries (including photographs and original drink recipes) submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this competition, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. 23. Each entrant warrants to the Promoter that their entry is the original work of the entrant only that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry that may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). 24. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a Finalist (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Sydney competition event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; and/or (g) attendance at the Sydney competition participating in the competition. 26. The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, also use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. 27.
