“2009 Cosmopolitan FFF” terms and conditions

Information on how to votes form part of the terms and conditions. Voting is open to all residents of Australia.
Participation in this voting process is deemed acceptance of these terms and conditions. The Promoters decision in relation to all aspects of this voting process is final and binding on all who participate and no correspondence will be entered into.

The entire voting period commences on 3rd August 2009 at 00:01 (EDST) and concludes on 11th September 2009 at 23:59 (EDST) (for internet entries) and/or last mail received (for mail entries).
Voting may be done during the voting period via the Cosmopolitan website www.cosmopolitan.com.au.
How to Vote:

Log onto the Cosmopolitan website and follow the specific voting instructions.

Incomplete, illegible and incomprehensible votes will be considered ineligible and will be discarded.

The Promoter in its complete discretion reserves the right to
verify the validity of votes and reserves the right to disqualify any voter for tampering with the voting process or for submitting a vote which is not in accordance with these terms and conditions. For the removal of doubt, if the Promoter for any reason whatsoever
disqualifies a voter then all votes submitted by that voter will not be included in the voting process.

Multiple votes are permitted.

Any votes submitted under the suspicion of using fraudulent means or interference with the integrity of the voting process will be invalidated immediately. This determination is made at the complete discretion of the Promoter.

All votes become the property of Cosmopolitan. The collection use and disclosure of personal information provided in connection with this voting process is governed by the Privacy Notice (see Contents Page for location in each issue of Cosmopolitan).

Votes not completed in accordance with these terms and conditions or received after close of the voting period will not be considered.

The use of any automated entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited.

If this voting process is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason whatsoever beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion (with reference to all relevant state and territory legislation), to the fullest extent permitted by law to (a) disqualify any voter; and/or (b) to modify, suspend, terminate or cancel the voting process, as appropriate.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
(a) Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) Any theft, unauthorised access or third party interference; (c) Any vote that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) Any costs incurred by a voter in accessing the promotional web page;

Caution: any attempt to deliberately damage the promotional website or the information on the promotional website, or to otherwise undermine the legitimate operation of this voting process, may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law
